Scratx Miami LLC, d/b/a Scratx("Scratx," "we," "our," or "us") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, share, and safeguard information when you visit our website, use our booking app, purchase our services, or visit our studio at 681 Brickell Key Dr, Miami, FL 33131 (the "Studio"). This Privacy Policy is incorporated by reference into our Terms of Service and Website Terms of Use.

1. Acceptance of This Policy

By using our website or app on any device, making a purchase, entering the Studio, or otherwise interacting with our services, you accept this policy and any changes to it. If you do not agree to this policy, please do not use our services. Your continued use following the posting of changes will be deemed your acceptance of those changes.

2. Information We Collect

Identity & Contact Information

• Name, email address, phone number
• Date of birth or age confirmation where required (for example, to verify adult account holders)
• For minors participating in lessons or sessions: name and age, provided by a parent or legal guardian

Account, Booking & Access Information

• Reservation and booking history
• Membership or package status, plan terms, and billing history
• Studio entry and access records (date, time, and credential used), generated when you unlock or check in
• Records of your acceptance of our Terms of Service, including the date, time, IP address, and version accepted

Payment Information

• Billing details and transaction history
• Card and bank details are collected and processed by our payment providers; Scratx does not store full card numbers

Performance Data

• Data captured by simulator and launch-monitor systems during your sessions, including club and ball measurements, shot data, scores, session history, and images or video of your swing captured by simulator cameras for the purpose of measuring play

Studio Video Surveillance

• Video recordings from security cameras in and around the Studio, including entry areas, common areas, and hitting bays. Cameras are not located in restrooms. Where audio monitoring is used, it occurs only in areas with posted notice, and your entry into those areas constitutes your consent to it

Communications

• Messages you send us, and records of emails, texts, and notifications we send you

Technical Information

• IP address, browser and device type, app usage data
• Cookies and similar technologies used for site functionality, performance, and analytics

3. How We Use Your Information

We use your information to:

• Provide and manage bookings, memberships, packages, lessons, and Studio access
• Process payments, renewals, refunds, and confirmations
• Verify identity and control entry to the Studio
• Communicate with you about your account, bookings, billing, safety information, and changes to our terms
• Send marketing communications where you have opted in (see "Marketing & Text Messages" below)
• Maintain the safety and security of guests, staff, and property, including through video surveillance
• Investigate incidents, damage, or violations of our Terms of Service, and establish or defend legal claims
• Deliver your Performance Data to you and maintain and calibrate simulator equipment
• Improve our website, app, and overall experience
• Comply with legal obligations, including records we must keep under Florida law

4. Marketing & Text Messages

We send two kinds of messages. Transactional messages (booking confirmations, receipts, billing and renewal notices, access and safety information) are part of the service and are sent to all account holders. Marketing messages are sent only if you opt in, and consent to marketing is never a condition of purchase. You can opt out of marketing email using the unsubscribe link in any message, and opt out of marketing texts by replying STOP. Message and data rates may apply. Opting out of marketing does not stop transactional messages.

5. Video Surveillance

The Studio and its surroundings are monitored by video for the safety and security of guests, staff, and property, and may be unstaffed during your session. Recordings may be used to verify access, investigate incidents and damage, enforce our Terms of Service, defend claims, and cooperate with law enforcement. Routine surveillance footage is retained for approximately 30 days and then overwritten, except footage preserved in connection with an incident, investigation, or legal matter, which is kept as long as needed for that purpose.

6. Sharing of Information

We do not sell or rent your personal information. We share information only with:

• Service providers that operate parts of our business on our behalf: our booking and access platform, payment processors, simulator and launch-monitor technology providers, email and text messaging providers, and analytics services
• Professional advisors and insurers, where needed to obtain advice or handle a claim
• Legal and regulatory authorities, when required by law, subpoena, or to protect the safety of any person or the security of the Studio
• A successor business, if Scratx is involved in a merger, acquisition, financing, or sale of assets, in which case your information may be transferred as part of that transaction subject to this policy

Some providers (for example, simulator technology platforms) may also process your Performance Data under their own privacy policies when you create an account with them directly.

7. Cookies & Analytics

We use cookies and similar technologies to understand how visitors use our site and app and to improve functionality. You can manage cookie preferences through your browser settings; disabling cookies may limit some features.

8. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, loss, or misuse. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

9. Children's Privacy

Our website and app are not directed to children under 13, and children under 13 may not use them. Accounts may be created only by adults; when minors participate in activities at the Studio, all required information is provided by and collected from a parent or legal guardian, and the app is intended to be operated by the supervising adult. We do not knowingly collect personal information directly from children online. If you believe a child's information has been collected without parental consent, contact us and we will promptly delete it.

10. Data Retention

We retain personal information only as long as necessary for the purposes described in this policy or as required by law. Note that some records have required or extended retention periods: transaction and contract records (including your Terms of Service acceptances) are kept for as long as needed to comply with Florida health studio and tax requirements and to address disputes; surveillance footage is retained as described above. When information is no longer needed, we securely delete or anonymize it.

11. Your Choices

You may:

• Update or correct your account information in the app or by contacting us
• Opt out of marketing communications at any time (see "Marketing & Text Messages")
• Request a copy of the personal information we hold about you
• Request deletion of your account and personal information, subject to legal and operational retention requirements (for example, transaction records and incident-related footage)

To make a request, contact us at support@scratxgolf.com. We will verify your identity before acting on a request and will respond within a reasonable time. Requests relating to surveillance footage may be limited to protect the privacy of other people in the recording.

12. Third-Party Services

Our website and app may link to or rely on third-party services, including payment, booking, and simulator platforms. Their handling of your information is governed by their own privacy policies, which we encourage you to review.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with a revised effective date, and we will notify you of material changes through the app or by email. We encourage you to review this policy periodically.
